LEMN DROPS – Returns & Refund Policy

This Returns & Refund Policy applies to all purchases made through LEMN DROPS.
By placing an order, you agree to this policy.
1. Nature of Our Products
LEMN DROPS provides:
- Custom-printed NFC music cards
- Secure NFC encoding services
- Hosting and streaming services linked to each card
All cards are produced specifically to the customer’s submitted artwork, music files, and order specifications.
Because our products are personalized and made-to-order, different legal rules apply compared to standard consumer goods.
2. Right of Withdrawal (EU Consumer Law)
Under EU consumer law, consumers generally have a 14-day right of withdrawal for online purchases.
However, under Article 16(c) of Directive 2011/83/EU and Spanish law (Real Decreto Legislativo 1/2007), the right of withdrawal does not apply to:
“The supply of goods made to the consumer’s specifications or clearly personalized.”
Since LEMN DROPS NFC cards are:
- Custom printed using customer-submitted artwork
- Encoded with specific music files
- Produced specifically per order
The 14-day withdrawal right does not apply once production has begun.
3. Order Cancellation
3.1 Before Production Begins
Orders may be canceled for a full refund if:
- The cancellation request is received before artwork approval and production start.
3.2 After Production Begins
Once production has started:
- Orders cannot be canceled.
- No refund will be issued.
Production typically begins after artwork approval and payment confirmation.
4. Defective or Damaged Products
We will replace or refund products if:
- Cards arrive damaged
- Cards are defective
- Cards do not function as intended due to manufacturing or encoding errors
To request a replacement:
- You must notify us within 7 days of delivery
- Provide photographic evidence
- Provide order details
If the issue is verified as a production defect:
- We will replace the defective cards at no cost, or
- Issue a partial or full refund (at our discretion)
5. Shipping Issues
5.1 Lost Shipments
If a shipment is lost in transit:
- We will investigate with the carrier
- Replacement may be issued once confirmed lost
We are not responsible for incorrect shipping addresses provided by the customer.
5.2 Customs & Duties
Customers are responsible for:
- Customs duties
- Import taxes
- Clearance delays
Refunds are not issued due to customs refusal or unpaid import charges.
6. Digital Services & Hosting
Hosting and streaming services are included in the one-time card purchase.
Under EU law, digital content that is supplied immediately and begins performance with consumer consent may not be eligible for withdrawal once performance begins.
By approving production and encoding, you acknowledge that:
- Digital hosting services will begin upon provisioning.
- The digital service component is non-refundable once activated.
7. Artwork & Content Errors
Customers are responsible for:
- Verifying artwork files
- Checking spelling, metadata, and design accuracy
- Reviewing proofs carefully
Refunds or replacements will not be issued for:
- Spelling errors in approved artwork
- Incorrect metadata provided by customer
- Customer-submitted file issues
Note: since the artwork is printed on PVC plastic material cards, there can be variation or differences in the print colors from those supplied in the artwork file. Colors are subject to vary on different screens, monitors, digital devices and print media. Refunds will not be issued for these variations and this should be considered before orders are placed.
8. NFC Functionality Disclaimer
LEMN DROPS uses secure NFC technology. However:
- NFC functionality depends on compatible devices.
- Device settings may affect performance.
- Metal objects or devices in close proximity to the NFC card can interfere with reading
- We are not responsible for compatibility limitations of older or unsupported devices.
This does not affect statutory warranty rights under EU law.
9. Statutory Warranty
Consumers within the EU are entitled to a minimum 2-year legal guarantee under EU and Spanish law for defective goods.
This guarantee covers:
- Manufacturing defects
- Non-conformity with contract
It does not cover:
- Normal wear and tear
- Misuse
- Unauthorized modification
- Damage to the NFC cards by explorer to strong magnetic interference
- Physical damage after delivery
10. Refund Method
Approved refunds will be processed:
- Using the original payment method
- Within 14 days of approval
We may withhold reimbursement until defective goods are returned (if applicable).
11. Return Shipping
If a return is approved due to defect:
- We will cover return shipping costs.
If a return is requested for reasons not covered by this policy:
- Return shipping costs are the customer’s responsibility.
- Restocking fees may apply where legally permitted.

13. Business Customers (B2B Orders)
For business customers:
- The statutory consumer withdrawal rights may not apply.
- Returns and refunds are governed strictly by contract and this policy.
